Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the AI Aarna website and its associated services (the "Service") operated by AI Aarna ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

• "Service" refers to the AI Aarna platform and all its features, including but not limited to the Creative Suite, AI Chat Bots, AI Voice Bots, Marketing Suites, Social Media Suite, AI content creators (Article Wizard, AI Code, etc.), AI Image/Video generators, AI Influencers, and SEO Tools.
• "User" or "You" means the individual or entity registered to use the Service.
• "User Content" means all data, text, files, prompts, brand voice information, bot training data, or other materials that you upload, input, or provide to the Service.
• "Generated Content" means the unique output (such as text, images, videos, audio, or code) that is created for you by the Service based on your User Content.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 18 years of age to create an account and use the Service.

3. Use of the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your internal business or personal purposes as permitted by your active subscription plan.

4. Content Ownership and Licenses

A. Your User Content

You retain all ownership rights, title, and interest in and to your User Content. We do not claim any ownership over your prompts, uploaded files, or other inputs.

To provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, process, and display your User Content *solely* for the purpose of operating, providing, and improving the Service for you. For example, we must be able to process your text prompts to generate an article or use your training data to operate your AI Chat Bot.

B. Generated Content

As between you and AI Aarna, and subject to your compliance with these Terms, **you own all right, title, and interest in and to the Generated Content.** You are free to use the Generated Content for any lawful purpose, including commercial use.

5. Acceptable Use Policy

You agree not to use the Service to:

• Create, upload, or disseminate any content that is illegal, harmful, hateful, harassing, defamatory, obscene, or infringing on any intellectual property rights.
• Engage in any activity that is deceptive or fraudulent, such as creating misinformation, spam, or phishing schemes.
• Generate malicious code with our `AI Code` feature.
• Attempt to reverse-engineer, decompile, or discover the source code or underlying AI models of the Service.
• Use any automated means (e.g., scraping, bots) to access the Service in a way that disrupts or overloads our systems.
• Violate the terms of service of any third-party platform you integrate with, such as using our `Social Media Suite` or `Marketing Suite` to send spam or violate the rules of Facebook, Instagram, X, LinkedIn, TikTok, WhatsApp, or Telegram.
• Represent that Generated Content was created by a human when it was not (e.g., for academic dishonesty or deceptive journalism).
• Use the `AI Influencer` or `AI Voiceover` features to impersonate any real person without their explicit consent.

You are solely responsible for all User Content you provide and all Generated Content you create and its subsequent use. We reserve the right to suspend or terminate your account for any violation of this policy.

6. Fees, Subscriptions, and Payments

A. Subscriptions

The Service is offered on a subscription basis. By subscribing, you agree to pay the fees specified for your chosen plan. All subscription fees are billed in advance on a recurring basis (e.g., monthly or annually).

B. Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings or by contacting our support team before the end of the current period.

C. Payments and Refunds

All payments are processed by a third-party payment processor. We do not store or collect your payment card details. All fees are exclusive of any applicable taxes, which you are responsible for paying.

All payments are non-refundable to the fullest extent permitted by law. There will be no refunds or credits for partially used subscription periods or for any features you did not use.

D. Price Changes

We reserve the right to modify our subscription fees at any time. We will provide you with reasonable prior notice of any price changes. Your continued use of the Service after the price change takes effect constitutes your agreement to pay the modified fee.

7. Third-Party Integrations

Our Service allows you to connect with various third-party platforms (e.g., Facebook, Instagram, WhatsApp, Telegram, etc.). Your use of these third-party services is governed by their respective terms of service and privacy policies.

We are not responsible for the operation, functionality, or data practices of any third-party service. We do not warrant that these integrations will be available, accurate, or error-free.

8. Termination

You may cancel your subscription and terminate these Terms at any time by accessing your account settings.

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms (especially the Acceptable Use Policy).

Upon termination, your right to use the Service will cease immediately. Any of your User Content may be deleted from our systems, though we may retain certain data as required by law or for legitimate business purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI AARNA, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• (i) your access to or use of or inability to access or use the Service;
• (ii) any conduct or content of any third party on the Service;
• (iii) any content (including User Content or Generated Content) obtained from the Service;
• (iv) unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless AI Aarna and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, b) your User Content, c) your Generated Content, or d) your violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., the State of Delaware, USA], without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in [Your City, State/Country], except for small claims that may be brought in small claims court. You and AI Aarna waive any right to a jury trial.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
